Havana Auto Publisher is a web-based tool that allows authorized TikTok content creators to authenticate their TikTok account via TikTok's official OAuth 2.0 protocol and upload and publish short-form video content directly to TikTok using the TikTok Content Posting API. The Service is designed for personal use by individual content creators managing their own TikTok accounts.

You may revoke this authorization at any time by disconnecting the app from your TikTok account settings at tiktok.com/setting, or by using the Logout function within the Service.
You are solely responsible for all video content ("Content") that you upload and publish through the Service. You represent and warrant that:
We do not review, screen, or endorse any Content you publish through the Service. You assume full responsibility for the consequences of publishing any Content.

The Service and its original design, text, graphics, and software are the exclusive property of Havana Auto Publisher. Nothing in these Terms grants you a right to use our trademarks, logos, or service marks. You retain all rights to the Content you create and publish through the Service.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR ANY INTERRUPTIONS OR ERRORS IN THE TIKTOK API OR TIKTOK'S PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAVANA AUTO PUBLISHER, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, OUR TOTAL LIABILITY SHALL NOT EXCEED USD $100.
You agree to indemnify, defend, and hold harmless Havana Auto Publisher and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including any Content you publish.
The Service integrates with TikTok's API. Your use of TikTok is governed solely by TikTok's own Terms of Service and Privacy Policy. We are not affiliated with, endorsed by, or sponsored by TikTok or its parent company ByteDance. We are not responsible for TikTok's services, content, or practices.
We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the Service.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
